Pay Rs 25 Lakh Relief To Kin Of Deceased, Blood Bank Told

The State Consumer Dispute Redressal Commission has ordered a blood bank to pay compensation of Rs 25 lakh to the kith and kin of a patient who died of ‘septic shock’ post transfusion of contaminated blood.

 

The commission asked the blood bank to pay the amount with 9% interest on the amount from the September 8, 2016 from the date of the filing of the petition. The commission order followed Sitaram Saini, the father of the diseased 25-year-old Rahul, approached the commission with compensation for medical negligence by the blood bank.

 

The petition said, Rahul was an employee of the Jaipur Vidut Vitaran Nigam Ltd (JVVNL) as a technical assistant posted at Chomu. Rahul admitted at the MJM Hospital Chomu for the treatment of piles in July 7, 2015. The doctors at the hospital asked for three units of blood on July 10 and the relatives procured the blood units from Life Care Blood Bank, Balaji Hospital, Murlipura in Jaipur at Rs 3,933. But the health of the patient began to deteriorate with the transfusion of the blood. He complained of diarrhoea and vomiting, and his body turned red. The doctors stopped the blood transfusion after 50 ML saying the blood was contaminated.

 

He was referred to C K Birla hospital and later to Santoba Durlabhji hospital in Jaipur. The blood test at these hospitals showed that Rahul was administered wrong group of blood which contaminated his blood. Rahul died on July 22 2015 of septic shock due to the negligence of the blood bank and the doctors of the hospital which administered the blood without verifying the blood group.The commission said though the MJM hospital where the patient first admitted was equally guilty of medical negligence by not verifying the quality of the blood, it was let free as the petitioner had not made it a party to the petition.
